1. Acceptance of these terms

By visiting or using thegoatdrink.com (the "Site") you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the Site. We may change these terms at any time by posting an updated version here. Your continued use of the Site after a change means you accept it.

2. Who we are

The Site is owned and operated by Conceptos Design LLC ("we", "us"). The Site provides information about GOATED, a nootropic performance drink made and sold by IQ Health LLC, 106 N. 6th Street, Boise, ID 83716 ("IQ Health"). We are an independent marketing partner of IQ Health. We are not IQ Health, we do not manufacture GOATED, and we do not sell it directly.

3. Affiliate disclosure

Purchase links on the Site are affiliate links. If you buy GOATED after clicking one, we may earn a commission from IQ Health at no additional cost to you. This does not change the price you pay. Product descriptions, ingredient information, and reported results on the Site are drawn from IQ Health's own product materials.

4. Orders, shipping and returns

All purchases are made on IQ Health's website, brainiqhealth.com. IQ Health is the seller of record and is solely responsible for pricing, payment processing, order fulfillment, shipping, returns, refunds, customer service, and any product warranty. Your purchase is governed by IQ Health's Terms and Conditions, Terms of Use, and Privacy Policy. Prices, promotions, and shipping offers shown on the Site, such as free US shipping over a stated order amount, are set by IQ Health and may change without notice. The price on IQ Health's checkout page controls.

5. Health information

GOATED is a dietary beverage, not a medicine. Information on the Site about ingredients, benefits, and reported results is for general informational purposes only. It is not medical advice and is not a substitute for the advice of your physician or another qualified health professional, or for the information on the product label. GOATED contains caffeine. Talk to a healthcare professional before using it if you are pregnant or nursing, sensitive to caffeine, taking medication, or have a medical condition.

6. US FDA disclaimer

This statement has not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

The products and the claims made about specific products on or through this document have not been evaluated by the United States Food and Drug Administration and are not approved to diagnose, treat, cure or prevent disease. The information provided on this document is for informational purposes only and is not intended as a substitute for advice from your physician or other health care professional or any information contained on or in any product label or packaging. 8. Reporting an adverse reaction

If you have a negative reaction to GOATED, stop using it and consult a doctor. Please also report the reaction to IQ Health at contact@brainiqhealth.com or 419-265-1375 so it can be investigated and, where required, reported to the FDA.

9. Age requirement

You must be at least 18 years old to use the Site. GOATED contains caffeine and is not recommended for children. IQ Health may apply its own age requirements at checkout.

10. License and intellectual property

We grant you a limited, revocable, non-exclusive license to view the Site for personal, non-commercial use. The Site's design, text, and original graphics belong to us. The GOATED name, logo, can and packaging artwork, product photography, and related marks belong to IQ Health and are used on the Site with permission as part of its affiliate program. You may not copy, reproduce, scrape, frame, or create derivative works from the Site or its content, or use any trademark shown on it, without written permission from the owner.

11. Acceptable use

You agree not to use the Site in any way that is unlawful, that interferes with its operation or security, that introduces malware, that attempts to gain unauthorized access to any system, that collects information about other users, or that misrepresents your identity or affiliation. We may block access to anyone who violates these terms.

The Site links to brainiqhealth.com and may link to other websites we do not control. We are not responsible for the content, policies, or practices of any third-party site. Linking does not imply endorsement. Your use of any third-party site is at your own risk and subject to that site's terms.

13. Disclaimer of warranties

The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses. Any product warranty is provided by IQ Health, not by us.

14. Limitation of liability

To the fullest extent permitted by law, Conceptos Design LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Site or any product purchased through a link on it. Our total liability for any claim relating to the Site will not exceed one hundred US dollars ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless Conceptos Design LLC from any claims, damages, and expenses, including reasonable attorneys' fees, arising from your use of the Site or your violation of these terms.

16. Governing law

These terms are governed by the laws of the State of Nevada, without regard to its conflict of law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Washoe County, Nevada, and you consent to their jurisdiction. The Site is intended for users in the United States. If you access it from elsewhere, you are responsible for complying with local law.

17. General

These terms and the Privacy Policy are the entire agreement between you and us about the Site. If any part is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. We may assign these terms in connection with a sale or transfer of the Site.
